These Terms and Conditions (“Terms”) govern your access to and use of the INFLUENZARS mobile application (the “Application”) developed by INFLUENZARS CONNECT Private Limited (“Service Provider”). By downloading or using the Application, you agree to be bound by these Terms. If you do not agree, please refrain from using the Application.

Definitions

• Influencers: Individuals who create, post, and offer promotional content or services through the INFLUENZARS platform.
• Users: Individuals or entities seeking to collaborate with influencers for promotional purposes, including businesses, agencies, or individuals.

General Use

Upon downloading or utilizing the Application, you are automatically agreeing to the following terms. It is strongly advised that you thoroughly read and understand these terms prior to using the Application. Unauthorized copying, modification of the Application, any part of the Application, or our trademarks is strictly prohibited. Any attempts to extract the source code of the Application, translate the Application into other languages, or create derivative versions are not permitted. All trademarks, copyrights, database rights, and other intellectual property rights related to the Application remain the property of the Service Provider.

The Service Provider is dedicated to ensuring that the Application is as beneficial and efficient as possible. As such, they reserve the right to modify the Application or charge for their services at any time and for any reason. The Service Provider assures you that any charges for the Application or its services will be clearly communicated to you.

The Application stores and processes personal data that you have provided to the Service Provider in order to provide the Service. It is your responsibility to maintain the security of your phone and access to the Application. The Service Provider strongly advises against jailbreaking or rooting your phone, which involves removing software restrictions and limitations imposed by the official operating system of your device. Such actions could expose your phone to malware, viruses, malicious programs, compromise your phone’s security features, and may result in the Application not functioning correctly or at all.

Please note that the Application utilizes third-party services that have their own Terms and Conditions, including but not limited to:

• Google Play Services
• Google Analytics for Firebase
• Firebase Crashlytics
• Facebook
• Youtube
• Instagram
• Sentry

The Service Provider is not responsible for issues arising due to lack of access to Wi-Fi, data exhaustion, roaming charges, or failure to keep the device charged.

The Service Provider may update the application at any time. You agree to accept all updates provided. The Application may be terminated at any time without notice.

General Terms (Applicable to All Users)

1. Platform Role
   INFLUENZARS is a discovery and matchmaking platform that enables influencers and users to connect and collaborate. INFLUENZARS does not guarantee outcomes and does not intervene in pricing, negotiations, or deliverables, except for limited internal dispute resolution.
2. Non-Refundable Charges
   All payments made to INFLUENZARS are non-refundable, except in cases of valid disputes or influencer-initiated cancellations.
3. Payment Security & Hold Process
   • Users make payments to INFLUENZARS, which holds the amount until the influencer submits deliverables via verification link over the platform.
   • Deliverables must be uploaded as a link (e.g., Facebook, Google Drive) through the app only.
   • Once approved by the user, payment is held for 7 days post submission of verification links and released the following Wednesday if no dispute is raised by user.
   • Refunds (if applicable) are processed to the original mode of payment.
   • A platform fee of ₹199 + taxes is charged per booking, refundable only in the case of cancellation or no-show by the influencer.
4. Legal Compliance
   All users and influencers are responsible for complying with applicable laws, including taxation and advertising norms.

Terms for Influencers

1. Posting, Pricing, and Promotion
   • Influencers independently create and post their own portfolios and listings.
   • Influencers are solely responsible for setting prices and defining deliverables for their own profile.
   • INFLUENZARS does not run influencer campaigns, fix pricing, or manage deliverables.
   • INFLUENZARS may boost visibility through internal promotions on the payment for an ad campaign, however, it does not guarantee specific performance outcomes.
2. Deliverables & Completion Criteria
   • Influencers must submit the agreed deliverables via the platform through a valid link.
   • A 7-day holding period follows submission before payment is released.
3. Payout & Taxes
   • Payments are made directly to the influencer’s registered & verified bank account.
   • TDS at 1% under Section 194C is deducted. PAN and bank details are mandatory.
4. Prohibited Activities
   • Fake engagement (bots, fake followers, etc.) is prohibited.
   • Any fraudulent behaviour may lead to suspension or termination.
5. Registration Fees
   • INFLUENZARS reserves the right to revise influencer registration or platform usage fees at any time without prior notice.

Terms for Users

1. Platform Usage
   • Users browse and select influencers based on their self-created portfolios and set pricing.
   • INFLUENZARS does not create campaigns, set deliverables, or influence pricing.
2. Payment & Refund Policy
   • All bookings are prepaid and processed through the INFLUENZARS platform.
   • Refunds are available only in the case of influencer no-show, cancellation, or failure to deliver.
   • Refunds are issued only to the original mode of payment.
   • A platform fee of ₹199 + taxes is charged per booking.

Additional Terms

1. User Verification
   • Users must link at least one valid social media account for verification.
   • INFLUENZARS may request additional identity verification.
2. Disputes Related to Tasks
   • Disputes regarding content quality, delivery, or no-shows can be raised through the app.
   • Platform fees are refunded only if the influencer fails to deliver or cancels.
3. Dispute Resolution
   • INFLUENZARS offers internal mediation only. It is not a legal arbitrator.
   • Outcomes may include refunds, warnings, or account actions.
4. User Ratings and Reviews
   • Influencers and users can review each other after a collaboration.
   • INFLUENZARS may moderate or remove misleading or harmful reviews.

Data & Privacy

INFLUENZARS only collects necessary personal data to deliver services. Some anonymized data may be shared with tools such as Meta, Google, and Firebase. INFLUENZARS is not responsible for data breaches caused by third-party tools.

Governing Law & Dispute Resolution

These Terms are governed by Indian law. Any disputes arising from these Terms will be resolved through arbitration in Noida, Uttar Pradesh.

Termination

INFLUENZARS may suspend or terminate accounts for violations. Users and influencers can delete their accounts at any time. No refunds are issued post-termination.

Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page. Continued use implies acceptance of the updated Terms.
